H-1B Visas Become Tougher for Applicants

The H-1B visa is a non-immigrant visa of the US which allows companies in the US to employ foreign nationals to work in fields that require specialization in theoretical and technical know-how. But the US president Trump administration has introduced some rules that have made the entire application process more stringent. With the new provisions, the Department of Labor requires US companies to disclose the number of already-employed foreigners in their payroll. This requirement makes it harder for these companies to take on new workers. The H-1B visa is popular among Indians, and the new requirement is necessary for that before bringing in more foreign staff, the Department of Labour will have to go through the company's labour application and approve it. Before approval, the Department of Labour must be convinced that there is no domestic worker who can’t take on that position and then authorize the company to go ahead to hire a foreign expert via the H-1B visa.

What are these new requirements?

Other new requirements of the H-1B visa include providing the conditions of employment of the potential foreign employee, such as places of employment, a period of work duration, and the expected number of foreign workers at each place of employment. Other requirements demand that the company provides a complete identification of secondary applicants and dependents of the H-1B worker. The companies also need to provide an estimate of the number of foreign workers in each of the company's branches listed in the application. The new form covering the new provisions of the H-1B visa will be released in weeks to come. The date will be announced on the official website of Foreign Labor Certification.
